Welcome to EV3 Mobile ("the Platform"), operated by "EV3 Africa" in partnership with "NunyaTech" ("we", "us", "our"). These Terms and Conditions govern your use of our mobile application, web dashboard, and related services ("Services"). By creating an account or using our Services, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and capable of entering a legally binding agreement to use this Platform.

2. Services Overview

The Platform connects EV drivers with charger owners (merchants).

Users can:

  • Locate nearby EV chargers
  • Start, pause, and stop charging sessions
  • Manage wallet funds and transactions
  • Track real-time session details and costs

Merchants can:

  • Connect and manage chargers via the OCPP protocol
  • Set pricing and monitor usage
  • Track revenue, payouts, and performance

3. Account Registration

You agree to provide accurate and up-to-date information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Wallet & Payments

  • You may fund your wallet using approved payment methods (cards or mobile money).
  • All wallet balances are stored digitally and can be used only for charging sessions.
  • We deduct session costs in real time during charging.
  • Refunds may be subject to review depending on the transaction type and status.
  • Platform commissions are automatically deducted from each transaction before merchant payout.

5. Merchant Revenue

Merchants receive earnings from completed charging sessions, minus the platform commission. Payouts are processed according to the merchant's configured schedule and subject to verification.

6. User Responsibilities

You agree not to:

  • Tamper with chargers or interfere with other users' sessions.
  • Misuse the app for fraudulent or unlawful purposes.
  • Attempt to reverse-engineer or copy any part of the software.

7. Platform Rights

We reserve the right to:

  • Modify, suspend, or terminate access to the Platform.
  • Adjust fees, commissions, or payment structures.
  • Update these Terms with or without prior notice (you will be notified in-app when major changes occur).

8. Data & Privacy

Your data will be collected, stored, and processed in accordance with our Privacy Policy. By using the app, you consent to such processing.

9. Limitation of Liability

We are not liable for:

  • Charger hardware malfunctions
  • Power interruptions or grid failures
  • Loss of data due to network issues
  • Indirect or consequential damages arising from your use of the Platform

10. Termination

You may deactivate your account at any time. We may suspend or terminate your account if you breach these Terms or engage in fraudulent activities.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which EV3 operates, without regard to its conflict of laws principles.
